Has Information Technology Raised the Level of Professional Competency?

Technology has changed the way we practice law. Searchable case law databases help us research faster, brief banks help us share work product, and document management systems help organize our cases. Many of these tools are exactly that: implements that help us work more efficiently and with greater organization. Lawyers can choose to use these technologies as they see fit.

However, in the electronic discovery arena, which is inherently tied to technology, failure to use available technologies limits a lawyer’s ability to represent the best interest of a client. In the age of electronic information, it is literally impossible to produce all relevant information without the use of some information technology. Thus, the question arises whether some minimum technological standards will be applied to attorneys practicing in this area.
